GENERAL RULES: The Lessee or using party shall be in charge of operation and is fully responsible for operation after receiving unit. Lessee agrees to supervise both the equipment and its use at all times said equipment is in the possession of the Lessee. Disclosed in this contract is a set of directions for use and safety rules that lessee agrees to follow and utilize at all times during the operation and use of the interactive inflatable game.A responsible ADULT must supervise and operate the inflatable and equipment at all times. Do not allow participants to enter the inflatable without ADULT supervisionAll participants must REMOVE shoes, jewelry, eyeglasses, combs or any other hard objects that could cause injury to other participants or to the inflatable itself.

Absolutely NO food, drink, gum, candy, SILLY STRING, CONFETTI, fingernail polish, paint, make-up, solvents, sticky substances, or PETS inside or on the inflatable.

When participants are in / on inflatables, there shall be NO flips, wrestling, running, pushing, climbing the net wall or any other aggressive behavior that could injure oneself or other participants. Participants shall not sit or lay down while other participants are bouncing around them. Do not let participants bounce against the sides of entrance. Participants must not be allowed to play on the step or front apron of any inflatable devices.

Only participants of compatible age and size shall be in the inflatable at the same time. Mixing participants of different sizes will greatly increase the risk of injury.

Refer to the warning and instructions on each unit for specific requirements on load/child ratio and operation for each unit.

Inflatable Units MUST be staked to the ground (or secured with sandbags or water bags for use outside on concrete) securely at all times to prevent tipping or injury.DO NOT USE IF WINDS EXCEED 15 MPH - inflatable units can flip over in high winds. If high winds exist, exit the inflatable immediately, clear the surrounding area (at least 15 ft. from units) of participants, and turn off the blower.

Keep children away from the blower unit at all times - risk of electric shock and serious injury.

THE FOLLOWING PERSONS ARE STRICTLY PROHIBITED FROM USING LEASED EQUIPMENT: CHILDREN / ADULTS THAT DO NOT MEET THE WEIGHT / HEIGHT REQUIREMENTS SPECIFIED ON EACH UNIT; PREGNANT WOMEN; INDIVIDUALS ON MEDICATION OR UNDER A PHYSICIANS CARE; THOSE WITH PHYSICAL AILMENTS, INCLUDING WEARING OF CAST, HEART CONDITIONS, SKELETAL / MUSCULAR
INJURY OR PAIN; INDIVIDUALS UNDER THE INFLUENCE OF ALCOHOL OR DRUGS; AND PERSONS WHO COULD BE INJURED IN ANYWAY BY THE STRENUOUS ACTIVITY LIKELY TO BE UNDERTAKEN.

TROUBLESHOOTING - In the unlikely event that the Unit begins to deflate while in operation, first remove all participants from the Unit and surrounding area (at least 15 ft. from units), then check the following: (1) The motor may have stopped, in which case, check the cord connection at the outlet; (2) If the motor is continuing to run, check the air intake on the side of the motor for blockage, and check both tubes at the back of the unit for snugness, re-tie if necessary; (3) Check and make sure the zipper(s) on the Unit is fully closed; (4) If you cannot correct the problem call - FUN DAY Inflatables, LLC at the number below immediately.

REPRESENTATIONS AND WARRANTIES BY LESSEE. Lessee represents and warrants:

A. That he/she has fully read this Agreement and that he/she has been instructed about and fully understands the safe operation of the Units. Lessee shall observe all safety precautions contained herein, including, but not limited to, constant supervision of the participants.     

ALL PARTICIPANTS ARE PARTICIPATING ON THE INFLATABLE UNITS AT THEIR OWN RISK.

B. That he/she shall keep the Unit in the same condition as when received, ordinary wear accepted.

C. That he/she shall be responsible for the safe return of the Unit to FUN DAY Inflatables, LLC. In the event that the Unit is not safely returned, Lessee shall pay FUN DAY Inflatables, LLC  the full fair market value of the Unit.

D. That he/she has received the Unit in good working order and condition.

DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY.

LEASER MAKES NO WARRANTIES OR REPRESENTATIONS, EITHER EXPRESSED OR IMPLIED, WITH RESPECT TO THE UNIT UNDER THIS AGREEMENT, ALL OF WHICH IS HEREBY DISCLAIMED AND EXCLUDED BY COMPANY, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR USE. IN NO EVENT WILL FUN DAY INFLATABLES, LLC BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY CHARACTER ARISING OUT OF OR IN CONNECTION WITH THE USE OF THE UNIT, INCLUDING, WITHOUT LIMITATION, ANY DAMAGES ARISING OUT OF PERSONAL INJURIES WHILE USING THE UNIT. LESSEE WAIVES ALL RIGHTS TO SUE FUN DAY INFLATABLES, LLC FOR ANY INJURY OR HARM IN ANY WAY, A CHILD/ADULT MAY SUFFER DUE TO NEGLIGENCE OR ANY OTHER CAUSE. I AGREE TO INDEMNIFY AND HOLD HARMLESS FUN DAY INFLATABLES, LLC, THEIR AGENTS, EMPLOYEES, DIRECTORS, ORGANIZERS, MANAGERS, OR MEMBERS FROM ANY CLAIMS, DAMAGES, LOSSES, INJURIES, DEATH, PROPERTY DAMAGE, AND EXPENSES ARISING OUT OF OR RESULTING FROM PARTICIPATION IN THESE ACTIVITIES.

All Participants are participating on the inflatable units at their own risk.
